Terms and Conditions

 

RETREAT TERMS AND CONDITIONS

 

Your contract (booking) is with April Moodie (The Nourish Co.)

Your contract (booking) will incorporate these Retreat Terms and Conditions (“Terms and Conditions”). It is therefore important that you read carefully, the following Terms and Conditions as these will form the basis of your contract.

Interpretation

1. Reference to “you”, and “your” means the persons named in the booking.
2. “We”, “Us”, “Organiser” and “Our” means April Moodie, the organiser of the retreat.

3. "Staff" means all facilitators hired to offer workshops during the retreat.
4. Reference to “retreat’ means the services we have agreed to provide or provide you with under your booking with us.
5. References to “Retreat Start Date” means the start date of the yoga retreat you have booked a place onto.
6. A reference to “in writing” refers to email only. The email should be sent to April Moodie at info@thenourishco.co.uk

 

1. Booking

​

(a) Your booking will only be confirmed once we have received a deposit from you. The amount of deposit payable will be confirmed to you by email, upon receipt of your enquiry of making a booking onto the retreat.
(b) All notices and communications regarding this contract should be sent by email to info@thenourishco.co.uk.
(c) We reserve the right to refuse to accept bookings in our absolute discretion without stating the reason for doing so.
(d) We will not share your personal details provided with any third parties.

2. Payment

​

(a) The price stated in the retreat brochure on our website and agreed upon booking is the exact amount to be received by us.

(b) Your deposit is non-refundable.

(c) The full payment amount is due either at the time of purchase or by arranged payment plan, agreed at the time of booking.

(d) If you miss any payments, you will receive a reminder and have 2 days to make payment, otherwise your booking will be cancelled. You will not receive a refund for any payments you have already made. 

e) Your final and full payment is due one month before the start of the retreat. Failure to make any outstanding payments may result in your place being withdrawn. You will not receive a refund for any payments you have already made.

3. Your Travel Arrangements

​

All travel arrangements are your responsibility and at your own cost. We shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel. Transfers to/from the retreat are at your own cost, unless otherwise specified.

4. Your Health

​

(a) It is your responsibility to let your Yoga Instructor know if you have any injuries and to be mindful at all times of your own body’s capability during the retreat. If you experience any injury or discomfort during any activity during the retreat, then you must desist immediately.

(b) It is also your responsibility to consult a doctor with an understanding of yoga to check that you are sufficiently fit and healthy to undertake yoga classes and other physical activities that you may choose to do whilst on the retreat.

(c) Please advise us of any mental or physical health conditions and dietary requirements before you book. If you have health conditions and dietary requirements that may be affected by the activities offered on our retreats we reserve the right to advise you to desist and in the interests of your wellbeing, or others, we may decline your stay at our retreats.

(d) Whilst all measures are taken to ensure a high standard of health and safety, we are situated in the countryside where the land is uneven and we shall not be responsible for any injuries caused by uneven terrain.

(e) Women who are 12 to 28 weeks pregnant should provide a letter from their health practitioner specifying that they are fit to travel and able to engage in the activities that we provide. We would prefer pregnant women to have done a little yoga before they arrive.

(f) Our food will be prepared to the highest possible standards but food preparation carries with it inherent risks. It is your responsibility to advise the organisers of any food allergies or intolerances, at least one week before the arrival date. We do not accept any liability for illness caused by food consumption.

(g) By participating in Nature Walks, Wild Crafting, Cacao Ceremonies, Workshops and Yoga, including ingesting Ceremonial Cacao, you assume all responsibility of any risk of injury or damage resulting from your participation.

5. Cancellation by you

​

(a) You may cancel your booking at any time; however, no refunds are provided. Cancellation will take effect the day such notification is received by us. If you are on a payment plan you must legally continue all the payments as agreed. However, if another person can be found to take your place, then we may offer you the opportunity to transfer your deposit to a future retreat, at our discretion.

(b) Bookings are for the stated period of the retreat. There are no refunds for an unused portion of the retreat. If the reason for cancellation is covered under the terms of your Insurance Policy, should you choose to take it out, you may be able to make a claim on your insurance.

6. Amendments by us

​

Occasionally, changes may have to be made (e.g. class times, venue or other arrangements), which we reserve the right to do at any time. If your accommodation has to be changed, we will do our utmost to provide accommodation of a similar rating. If, for any reason, April Moodie is unable to host the retreat herself in person, a substitute teacher/facilitator will be found to take her place. If a significant change becomes necessary, we will inform you as soon as reasonably possible if there is time before your departure. No refunds or compensation will be given to guests for such changes.

7. Workshops

​

While you may receive reminders to attend meals, workshops, and classes, it is your responsibility to check dates and times. You agree to arrive promptly and to be present and available for the workshops and classes, and failure to do so may result in

you missing a session (sessions are optional).

​

8. Cancellation by us

​

We reserve the right in any circumstances to cancel a retreat. In particular our retreats require a minimum number of at least 75% of the participants to have booked by 30 days before the start date. If this minimum number is not reached by that date we may cancel and refund the money to you. If we have to cancel the retreat after this date for any other reason, you will receive a full refund of any amount that has already been paid.

9. Our liability to you

​

(a) We accept responsibility for ensuring that the retreats are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.

(b) We do not accept any liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond our control.

(c) We are not liable for any injuries you may incur. Yoga classes, workshops and optional activities are undertaken at your own risk. We are not liable for any medical or psychiatric conditions, which may develop during or subsequent to the retreat. We are not liable for loss of, or damage to, your personal property.

10. No Liability for possessions

​

It is your responsibility to ensure that your possessions are kept safe at all times. This includes hire cars or other hired equipment.

 

11. Complaints

​

If you have a problem during your retreat, please inform the organiser immediately and he/she will endeavour to put things right. Please note that we cannot be responsible for the individual behaviour of any group member or other guest sharing your accommodation.

12. Privacy Policy

​

We do not share customer details with any 3rd parties. Any personal information that you provide to us will be used only for the service you requested. This information is used only for administration of the site system and in the compilation of statistics used by us to assess the use of the site. This privacy policy does not cover the links within this site linking to other sites.

​

13. Photography

​

I, for good and valuable consideration, the receipt of which is hereby acknowledged, hereby irrevocably authorise April Moodie to use photographs of me and or my property and authorise her and her assignees, licensees, legal representatives and transferees to use and publish (with or without my name) photographs, pictures, portraits or images in any and all forms and media and in all manners including composite images or distorted representations, and the purposes of publicity, illustration, commercial art, advertising, publishing (including publishing in electronic form on CDs or internet websites), for any product or services, or other lawful uses as may be determined by the photographer or studio name here. I further waive any and all rights to review or approve any uses of the images, any written copy or finished product. I am of full legal age and have read and fully understand the terms of this release.

If you do not want to be in any photos or videos, that is totally fine - please inform us in advance.

14. Other Agreements

​

(a) I agree to fully release and hold harmless April Moodie (The Nourish Co) (the company and all members of staff) from and against any and all claims or liability of whatsoever kind or nature arising out of or in connection with the above (the company and all members of staff).

(b) I agree that I shall not in any way conduct myself inappropriately and the final decision as to what defines inappropriate behaviour lies with the retreat organiser April Moodie.

(c) I understand that the materials and workshops must not be filmed and permission must be received from the retreat organiser for photography. We hold the right to refuse photography/videography of any of the workshops.

(d) I understand that the materials, workshops, sessions I attend and knowledge I gain can not be appropriated. I am not allowed to copy, share, and/or distribute any of the materials or knowledge learned. I am not allowed to teach the materials to other

professionals for free and/or for money.

(e) I understand that I am free to withdraw from or reduce my participation in the activities, programs, and sessions at any time.

(f) I acknowledge and understand that I am using the facilities at the Retreats at my own risk. In consideration for being permitted to participate in services, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the services offered and/or my presence at the premises at which April Moodie's retreats operate.

(g) I agree to indemnify and hold releases harmless from any and all liability and damages incurred arising out of my conduct or activity (or the conduct or activities of those for whom I am responsible) while attending the retreat or participating in offered services.

(h) I understand that if I act in an inappropriate manner to anyone during the retreat, if I cause any inconveniences then I may be asked to leave the retreat and no compensation or refunds will be provided.

(i) I understand that no recreational drugs are permitted on this retreat, failure to comply with this may result in you being asked to leave.

YOGA STUDENT WAIVER AGREEMENT

I understand that yoga requires and includes physical movements. I realise that yoga also provides relaxation, stress relief, stress education and awareness. As with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will notify the instructor, adjust my posture and listen to my body. I will not push my body too far and will ask for support from the teacher if needed.

 

Yoga is not a substitute for medical care or diagnosis. Yoga can work well in conjunction with traditional medical care. I will practice yoga only after discussing it with my doctor and gaining their approval. I affirm that I alone am responsible to decide whether to practice yoga. I hereby agree to irrevocably release and waive any claims that I have now or hereafter may have against April Moodie.

 

I, hereby agree to the following:

​

1. That I am participating in yoga classes offered with April Moodie (and staff), where I will receive information and instruction about yoga. I understand that yoga requires physical exertion which may be strenuous and may be strenuous and may cause physical injury. I am fully aware of the risks involved.

​

2. I understand that it is my responsibility to consult with a physician prior to and in reference to my participation in yoga classes. I warrant and represent that I am physically fit and have no medical condition that would prevent my full participation in yoga.

​

3. In consideration of participating in yoga, I agree to assume full responsibility for any risks, injury or damages, which I might incur as a result in participating yoga.

​

4. I knowingly and voluntarily waive any claim I might have against April Moodie (and staff) for injury or damages that I may sustain as a result of participating in this program.

​

5. I, my heirs or legal representative forever release, waive, discharge and covenant not to sue April Moodie (and staff) for any injury or death caused by their negligence or other acts.

 

I have read the above release and waiver of liability and I fully understand its contents. I fully and voluntarily agree to the above terms and conditions.
